UPDATED EXCLUSIVE: Calgary doctor’s office raided by regulators searching for vaccine exemption files

The office of a Calgary doctor was raided Thursday morning by College of Physicians and Surgeons of Alberta (CPSA) officials searching for files of people for whom he granted COVID-19 exemptions.

And one of the files they accessed was of lawyer Jeffrey Rath — who has filed a lawsuit against the college over vaccine mandates.

And the family of a two-year-old whose file was seized says they are considering a lawsuit for the breach of privacy.

“They walked in this morning just after 8 a.m. and asked to do an inspection and review of my patient records for the last 180 days,” said Dr. Dan Botha, in an exclusive interview with the Western Standard.

Botha said there were two CPSA staff members — an administrator and a doctor — who handed him a one-page letter requesting he provide access to his patient files for the inspectors “under section 53.1 of the Health Professions Act (HPA).”

The letter indicated the inspection was to “ensure the issuance of medical exemptions for vaccination against COVID-19 are in adherence to the provincial vaccination exemption program, medical exemptions for face mask are in adherence to provincial public health orders and the prescribing of Ivermectin is in adherence with CPSA Standards of Practice.”

“You are expected to cooperate with the inspectors and provide them access to your office records,” said the letter.

“They wanted to know if I had written any exemption letters for the vaccine or masks or had been prescribing Ivermectin to my patients,” said Botha.

“I told them I had written two — one for a cancer patient of mine and another for a child who has Rett syndrome.”

Botha said his cancer patient was undergoing treatment and he had provided the patient with a three-month vaccine exemption until treatments were finished and the patient’s health could be reassessed.

He also said he provided a permanent mask exemption to a child he is treating with Rett Syndrome, an autism spectrum disorder that affects the way the brain develops, causing a progressive loss of motor skills and speech.

“I did prescribe Ivermectin with success for COVID-19 treatment with maybe 20 or so patients,” Botha confirmed, but added he stopped prescribing it when it was banned for use in treating COVID-19.

Botha said he gave the inspectors access to the information for the two patients he had written medical exemptions for and they asked him to leave his office.

“I continued to see patients while they were in my private office for about an hour,” said Botha, adding the pair left while he was with a patient.

Botha, clearly shaken by the events that unfolded, said he and his staff “work hard to look after the public” and claims his practice follows “very high standards.”

“We never speak against the vaccine here and always refer patients to the government website and encourage them to contact the government as well if they have any questions or concerns,” said Botha.

“I’ve been a physician for over 38 years and I’m not against any government policy, but this is starting to feel like harassment.”

Botha said he checked his computer and could see the inspectors had accessed 28 patient files, including the medical files for his patient, lawyer Rath.

“Out of the 10,000 files on my system, they specifically accessed Mr. Rath’s file along with others,” said Botha.

Rath, of Rath & Company, was outraged by the raid.

“CPSA just raided my doctor’s office and illegally accessed my own personal medical file without my consent,” said Rath.  

“My GP called me to inform me that the CPSA had stormed his office this morning under section 53 of the Health Act to ‘randomly review some of his patient files’ and it just so happened that my file was one they randomly chose,” said an angry Rath.

“This is pure Gestapoism!”

Rath has actively challenged the CPSA on a number of occasions while representing medical professionals and clients who are pushing back against the mandatory vaccination policy.

Rath spoke with the mother of the child Botha had provided a mask exemption for shortly after the raid at the doctor’s office and said she has given her full consent for Rath to speak on her behalf.

“This child cannot sit unassisted and is in a constant state of respiratory distress,” quoted Rath on behalf of the mother.

“This mother has advised our office (Rath & Company) that she is contemplating legal action against the CPSA for the gross violation of her family’s right to medical privacy and the degree to which her family has been traumatized by this completely unethical and immoral conduct by the CPSA.”

Rath said he is “furious” with the CPSA.

“I am completely appalled by the CPSA investigators, including Jason MacDonald and Dr. Jeff Robinson, that they would think it’s appropriate to access the private medical file of an officer of the court who is engaged in litigation on behalf of my clients with the CPSA,” said Rath.

Botha, runs Rhythm Health, a family medical practice in southwest Calgary.

His website reads: “Dr. Dan Botha has been practicing medicine in Calgary for the past 25 years. In 1983 he graduated with a Bachelor of Medicine and a Bachelor of Surgery from the University of the Orange Free State in Bloemfontein, South Africa.”

The Western Standard contacted the CPSA for comment and was provided with this statement from a CPSA spokeswoman:

“Under Part 3.1 of the Health Professions Act (HPA), CPSA has the authority to conduct unannounced on-site clinic inspections to confirm that physicians adhere to our Standards of Practice. These are being facilitated when a certain threshold is breached.

“As we’ve seen an increase in the number of concerns submitted from both regulated members and Albertans during the pandemic, CPSA felt it was important to take this approach, to ensure patients across the province are receiving safe and competent care that is compliant with public health measures.

“There are a number of outcomes that can occur from these inspections, such as a referral to CPSA’s Continuing Competence team for an educational intervention, or to the Professional Conduct department in cases where allegations of unprofessional conduct are substantiated. A practice restriction can be imposed on a physician’s practice permit in a number of different ways under the HPA, including as a result of an inspection. A practice restriction on a physician’s practice permit is public information available on the physician’s profile on the CPSA website.”

    I have come to realize the Globalists are panicking and are actively stepping up their game. We have to act now as citizens of freedom we cannot fight this through conventional means. Civil disobedience is the only way, we cannot wait till the next election or spend years in the corrupt court system we have to act now as a group of like minded people.

    One of these health inspectors is going to mess with someone who doesn’t care anymore, and one of them will get a beating or worse. I’m amazed I haven’t heard of these vultures getting physically straightened out. It would do good, put some fear in these pigs and make them think twice about messing with people

    Jeff Rath is a huge threat to the CPSA that’s why they raided the doctor’s office. Makes me think they are scared he is going to win in court and expose a whole lot of things. All I want to know is how we can support Jeff and the doctors he represents.

    the doctors in the USA are already organizing against their professional associations. Mccullogh has more professional qualifications than all of the medical regulators in canada combined. The ivermectin prohibition shows how incompetent these College doctors are. Every family of every Covid death should be suing these guys. Maybe criminal prosecutions also should be happening.

    I have lost all respect for the College of Physicians and Surgeons of Alberta (CPSA). They have shown themselves as nothing more than a political organization that can be bought off. They are not concerned with health but with ideology.

    Imagine that. This doctor only gave 2 medical exemptions and for very valid reasons. I would think it would be illegal for them to confiscate private medical information of a lawyer is representing clients in litigation with the CPSA.

    They are very clearly trying to ban all medical exemptions and all treatment of COVID-19 in order to push the experimental gene therapy injections. Very evident that they have been bribed and they do not care at all about human life.

    Who oversees the CPSA? Should not disciplinary action be taken? How many blatant abuses and malpractice must they commit before action is taken people push back?

    The goal of all the ones In control are plainly out there to see. If only people would admit there is another side to the issue and debate it. But for the vaxed it means admitting doing something that maybe they were wrong to do and that thought is devastating. Just the fact the government and lots of scientists will not debatethe other side says volumes.

    This is absolutely outrageous. The government needs to have its own investigation of these thugs immediately–if Kenney cant or wont do it, he needs to immediately resign. Picket the leg. Call for these officials to resign.

    This is really unbelievable! The doctors need to rise up and call for the resignation of thes regulators. And if any more “raids’ happen, they should (as nicely as is warranted) tell these “investigators” to take a hike and not come back until they have a court order in their hands.

    The vaccine is already proven to be dangerous. On November 12th, the CDC released the latest figures from the VAERS (Vaccine Adverse Event Reporting System). To date, children ages 12 to 17 have suffered 22,782 total adverse events, including 1,400 rated as serious, and 29 reported deaths. Among the deaths: a 17-year-old girl from Washington, a 12-year-old girl from South Carolina, a 13-year-old girl from Maryland, and a 17-year-old girl from Texas. 59 cases of life-threatening anaphylaxis were reported in this age group – with 96% attributed to Pfizer’s vaccine. 552 cases of myocarditis and pericarditis (heart inflammation) were reported, with all but 10 linked to Pfizer, and 131 cases of blood clotting disorders, with 100% linked to Pfizer.

Sask Polytech ditches vax policy but burdens unvaxxed with testing costs

The Justice Centre is unsatisfied with the response of Sask Polytech and reiterated its intention to pursue legal action against the institution and against the University of Saskatchewan over its requirement for staff and students to be vaccinated for COVID-19.

The Justice Centre for Constitutional Freedoms is unsatisfied with the decision of Saskatchewan Polytech to reverse its vaccination requirement for staff and students because the institute does not recognize natural immunity and imposes testing costs on the unvaccinated.

On November 19, the Justice Centre sent Sask Polytech and the University of Saskatchewan letters demanding they reverse their requirement that all staff and students be vaccinated by January 1, 2022. 

On December 1, Sask Polytech reversed its “vaccinated only” policy but now requires unvaccinated staff and students to comply with testing three times a week at their own expense. In a press release, the Justice Centre called this “unacceptable.”

“Such testing requirements for students are even greater than the Saskatchewan government’s requirements for employees of its ministries. Sask Poly has also failed to recognize the compelling scientific evidence of natural immunity for those who have already recovered from Covid-19 and have proof of antibodies,” reads a JCCF press release on Saturday.

“Testing costs, which could exceed $200 per week, mean that only the wealthy and privileged can bear the burden,” stated Andre Memauri, the Justice Centre’s Saskatoon-based lawyer.

“Sask Poly, which has chosen to impose discriminatory testing requirements for staff and students, has the ability to acquire these tests at wholesale cost.”

The Justice Centre said it would commence legal proceedings against Sask Poly in the Court of Queen’s Bench unless Sask Poly immediately absorbs the testing costs and recognizes natural immunity. 

On October 28, the U of S and Sask Polytech announced mandatory vaccinations for all students, staff and faculty, removing the alternative of twice weekly testing which had been in place since the start of the school year. The Justice Centre will also commence legal action against the U of S for refusing unvaccinated students. 

On November 26, Global News reported a 19-year-old student was hospitalized briefly with breathing problems after receiving the Johnson and Johnson vaccine. The student’s mother, Michelle Marciniuk, publicly called for the university to reconsider its policy.

The U of S’ policy includes exemptions on medical and religious grounds in accordance with the Saskatchewan Human Rights Code. But according to the Justice Centre, the university usually rejects exemption requests or does not respond to them for several weeks. Besides this, the university has made itself the arbiter of faith considerations for religious exemptions. Medical exemptions have become a difficult document for patients to receive in Canada, due to regulatory pressure on physicians not to provide them based on their medical judgement except in very rare circumstances.

The U of S crowns itself for academic freedom, diversity, equality, human dignity and a healthy work and learning environment, yet it has harshly terminated faculty for speaking on the hallmark principle of informed consent for Covid-19 vaccination of children,” stated Andre Memauri, a U of S alum. 

“Now, the U of S seeks to exclude and villainize those who decide for various reasons not to be vaccinated…Without question, our community has been through a great deal of difficulty and it requires these institutions to lead as vessels of science not ideology…The Justice Centre demands both schools follow the science and adopt policies that bring students together in the most safe and lawful manner.”

The letters sent to both schools from the Justice Centre on November 19 warned that the schools are seeking to deprive students from education on the basis of vaccination status, contrary to Article 26 of the Universal Declaration of Human Rights and Sections 2(a), 7, and 15 of the Canadian Charter of Rights and Freedoms.

CRA wants more tax filers to file online

The government’s own research shows millions of paper filers resist change.

“Those who submit their taxes by mail most often say they use paper rather than filing electronically because it is simply how they prefer to do it, e.g. they do it out of habit, because ‘it’s what they are comfortable with,’ they like it, etcetera,” said a Canada Revenue Agency (CRA) report.

“Just 13% cite security issues.”

Data show of 30.5 million tax returns filed this year a total 2.7 million or 9% were filed on paper. Millions of taxpayers, a total 4,234,772 including Internet filers, demanded refunds be paid by mailed cheque instead of direct deposit.

The CRA complained it would be “more timely and efficient” if all taxpayers used the Internet. The Agency spends $6.9 million annually mailing T1 general tax forms alone.

“There is still a sizable proportion of taxpayers who are conducting their business with the Canada Revenue Agency through paper rather than taking advantage of digital services which are much more timely and efficient,” said the report.

Research showed typical paper filers were working age men under 55 who completed their own return without a tax preparer, had a university degree, earned more than $80,000 a year and were more likely than other Canadians to prefer in-person teller service rather than online banking.

“The most important factor influencing why respondents file by paper instead of online is disinterest,” wrote researchers, who added: “Apathy is a barrier. Fifty percent of likely switchers say they are simply not interested in switching. Therefore the agency will have to demonstrate the value of switching.”

Findings were based on questionnaires with 2,000 taxpayers who filed returns by mail. The Agency paid Earnscliffe Strategy Group $130,061 for the survey.

The research follows a failed 2012 campaign to have all Canadians use direct deposit for payment of tax refunds and benefit cheques. The attempt by the Receiver General of Canada, the federal office responsible for processing payments, was intended to save costs. Paper cheques cost 82¢ apiece to process compared to 13¢ for electronic transfers, by official estimate.

An estimated 13% of taxpayers refused to surrender bank account information to the Receiver General. “Cheque recipients have become harder to engage,” said a 2020 Department of Public Works survey.

“A few have a general distrust of the Government of Canada’s ability to protect data,” wrote researchers. A total 23 percent of Atlantic residents said they wouldn’t rely on the government to protect their privacy, followed by 22% in Saskatchewan and Manitoba, 21% in Ontario, 19% in Alberta, 18% in BC and 12% in Québec.

Attended by a sizable entourage, Guilbeault exited his black gasoline-powered SUV and hustled into the McDougall Centre in Calgary for a meeting with Alberta Environment Minister Jason Nixon.  

Guilbeault has dedicated most of his career to telling Canadians they need to transition from petrochemically fueled transportation. During this meeting though, Guilbeault chose not to find an utilize an electric-powered SUV in order to demonstrate his environmental virtue. With the resources of the entire federal government behind him, one would have thought that Guilbeault could have arranged appropriate transportation for his cross-Canada tour.  

It’s almost as if electric vehicles are still not ready for mainstream use yet. 

At least Guilbeault contributed to the Western economy with his conspicuous consumption of local petrochemical products.
